Partner Visas

Australia offers Partner visas, both temporary and permanent, that enable married or de facto partners of Australian citizens, permanent residents, and eligible New Zealand citizens to obtain visas in Australia.

These visas, 820/801 (onshore) and 309/100 (offshore), grant access to Medicare and work opportunities in the country. You have various pathways (onshore and offshore) available to sponsor your partner to come, stay, and work permanently in Australia.

Eligibility

To be eligible for the 820/801 (onshore) and 309/100 (offshore) visa, you must meet the following criteria:

  • Spouses of Australian citizens, permanent residents, or eligible New Zealand citizens.
  • Fiancés of Australian citizens, permanent residents, or eligible New Zealand citizens.
  • De facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens.

Sponsor Eligibility

  • The sponsor must not have sponsored more than one partner before.
  • The sponsor must not have been sponsored by a partner within the last 5 years, unless there are exceptional circumstances.
  • The sponsor must provide police clearance certificates for each country they have lived in for at least 12 months in the past 10 years.

Requirements

You will need to provide the following as evidence to apply for the visa:

  • For marriage-based applications, you must be legally married to an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • For de facto relationships, you need to provide evidence of a 12-month relationship (unless registered as a de facto couple).
  • Both you and your partner must be at least 18 years old and not closely related.
  • It is essential that you and your spouse/partner are in an exclusive relationship and either live together or temporarily live apart.
